GENERAL PRIVACY POLICY

1. DATA CONTROLLER, LEGAL BASES, INTENDED PURPOSES

All incoming data will be stored and processed by us in compliance with legislation applicable to data privacy, in particular the General Data Protection Regulation (GDPR), the German Data Protection Act (BDSG) and the Telemedia Act (TMG). Some of the data collected is provided directly by you. For instance, data entered into contact forms when making an inquiry. Other data is automatically collected by our IT system when you visit our website (please also read point 4 and onwards with regard to this). Your personal data will be used and stored in order to perform the agreement that has been concluded with you, or to execute actions requested by you, e.g. for preparing a bid, or responding to a contact inquiry (Art. 6 (1) lit. b GDPR) and for advertising purposes (Art 6 (1) lit. f GDPR). As soon as the personal data is no longer required for achieving the intended purpose, it will be deleted. If any statutory retention obligations apply, the data will be held until expiry of the retention obligations and subsequently deleted.

2. DISCLOSURE OF DATA TO THIRD PARTIES

As a matter of principle, your personal data will be known only to those persons concerned with handling your inquiry, processing your order, or sending the newsletter. Disclosure of your personal data to third parties will take place only when this is necessary for the purposes of performing the agreement should you have expressly agreed to the disclosure, or if such disclosure is permitted under data protection law. In each case, however, only the necessary data will be transferred. The potential recipient of personal data collected via the website is our website administrator who is bound to comply with our instructions, is obliged to observe data protection regulations and is not permitted to use the data for any other purpose.

3. RIGHTS OF THE DATA SUBJECT

Subject to certain requirements and at no charge, you have the right to receive information about your personal data stored on our system, to have inaccurate data corrected, to request that your personal data is deleted, or to have limits set regarding processing or transferability.

You may at any time and with future effect object to the use of your data for direct marketing purposes; you may also object at any time and with future effect to the use of the data on the basis of Art. 6 (1) lit. f GDPR for reasons relating to your particular situation without incurring any costs beyond the basic cost of transmission.

In some cases, however, we are not permitted to completely erase user data due to legal retention requirements.

Furthermore, we shall like to inform you of your right of complaint to a regulatory authority, in this case Baden-Württemberg’s Commissioner for Data Protection and Freedom of Information, Königstraße 10a, 70173 Stuttgart.

5. Use of GOOGLE WEB FONTS

To ensure the uniform presentation of typefaces on your device, we use Google Fonts, a service operated by Google Ireland Limited, Google Building Gordon House, 4 Barrow Street, Dublin, D04 E5W5, Ireland (Google). The integration of the web fonts takes place via an interface ("API") to the Google services. For this purpose, your browser must connect to the Google servers. As a result, Google becomes aware that our website was accessed using your IP address. It cannot be ruled out that Google also transmits the collected information to a Google server in a third country, in particular a server belonging to Google’s parent company Google LLC based at 1600 Amphitheatre Parkway, Mountain View, California, USA. Google LLC is certified under the EU-US Privacy Shield (information on such can be found by entering the search term ‘Google’ at www.privacyshield.gov/list). The Privacy Shield is an agreement between the European Union (EU) and the USA that is designed to ensure compliance with European data protection standards in the USA. If you are signed into your Google account, Google may, depending on your account settings, add the processed information to your account and treat it as personal data. The use of Google Web Fonts is carried out in the interest of providing a consistent and appealing presentation of our online offer. 2. . PURPOSE AND LEGAL BASIS OF PROCESSING YOUR PERSONAL DATA

We process personal data pursuant to Art. 6 (1) lit. b GDPR, required by us to fulfil obligations resulting from the contractual relationship with our business partners, in particular for project execution, correspondence and invoicing. This includes in particular the person’s title, first name, surname, a valid email address, postal address, telephone number (landline and/or mobile) and bank account details.
We may process personal data for advertising our own services (for instance for event invitations, project reports, greeting cards). This is a legitimate interest pursuant to Art. 6 (1) lit. f GDPR. You may object to this processing at any time.

3. CATEGORIES OF RECIPIENTS

Transferring your personal data to third parties takes place only, to the extent necessary to fulfil the purpose of executing the agreement (e.g. project communication) should you have expressly agreed to this (Art. 6 (1) lit. a GDPR) or if such disclosure is permitted under data protection law. Categories of recipients of personal data are in particular project participants (for example the contracting entity, executing companies, and other planning participants). In addition, we employ IT service providers. The latter are service providers bound to comply with our instructions, are obliged to observe data protection regulations and are not permitted to use the data for any other purpose.

We will store the personal data for as long as is necessary (Art. 6 (1) lit. c GDPR) for the purpose of processing in compliance with the legal retention periods (e.g. according to the German Commercial Code (HGB) and the German Tax Code of ten years for tax relevant documents, or six years for other business correspondence). Storing data beyond legal retention periods is possible if you have expressly consented to this pursuant to Art. 6 (1) lit. a GDPR) or the purpose of processing the data has not lapsed.

2. PURPOSE AND LEGAL BASIS OF PROCESSING YOUR PERSONAL DATA AS WELL AS INFORMATION ON STORAGE DURATION

The personal data you voluntarily disclose to us as part of the application process – particularly first and last names, address, email address, date of birth, occupation, CV, references and special categories of personal data (e.g. religious beliefs or health data) – will be processed by us. Additional data relevant to the application and acquired during the application process will also be processed. Your personal data will only be processed with regard to the application process. The legal basis for processing such data is §26 (1) 1 of the German Data Protection Act (BDSG).
In the case of your application being unsuccessful, your personal data will be deleted no later than six months after the application process has ended, unless the processing of you data is necessary for establishing, exercising or defending legal claims (cf. Art. 17 (3) lit. e GDPR). Otherwise, your data will be transferred to your personnel file.
Processing your data beyond the precise limits of the application process will only take place should you have expressly consented to your data remaining in our database thus allowing us to contact you at a later date regarding vacant positions, if need be. Should we fail to contact you, you can at any time and with future effect withdraw your consent in writing, by email or by phone. Otherwise, we will delete your data after two years. Should we contact you concerning new positions during this time, the period shall begin anew.
